This is a follow up on the Mexico real estate blog that I wrote last summer regarding  a cool 14 units complex near Mamitas beach written about Playa del Carmen condos (click here).  I paid a visit recently as the developer had mentioned that the showroom was about to be opened to the public. This developer has been building in Playa for many years and has many great projects already accomplished.

The location is excellent and these 14 units will share an amazing common rooftop area with an infinity pool and deck, that overlooks the most popular beach zone in all of the Riviera Maya, Mamitas beach. These Playa del Carmen condos have ocean views that are panoramic and to Cozumel as well. It is only 1 block away from both Mamitas beach club and Kool, as well just another block away from the 5th Ave for shopping and dining.

There are 3 different model types of 1,2 and 3 bedrooms ranging from 767 sq.ft up to 1900 sq.ft in 4 levels. The elevator goes right up to the common area and there is underground parking. Top quality features throughout as you can see in the photos I took of the model and construction progress.

Another Addition to the Playa del Carmen condo family……

Ever imagined being able to sit at home and enjoy a meal cooked by a chef in your own kitchen?

Signs are up advertising an open model unit, and I’m looking forward to getting in there and seeing what this development is going to offer.

Looking at places the development has 40 Towers in total, with 3 floors in all, and from what I can see you will have 4 choices of units.

• 2 bedrooms 2 ½ bathrooms
• 2 bedrooms 2 ½ bathrooms Penthouse
• 3 bedrooms 3 bathrooms

3 bedrooms 3 bathrooms penthouse

The Penthouses have their own private roof top area, with a covered seating area, whirlpool and shower.

I’ve been reading that this development will have 24hr security and secure underground parking for all the residents as well as reserved parking spots for guests.

You will also have access to cleaning services, Concierge, 5 swimming pools, spas and boutiques, gym, movie theatre, medical and first aid services, chef and sous-chef services, personal training and more.

Prices for your own condo here range from $250,000USD to $310,000USD (These are prices as of pre-construction and are subject to change) So far 5 months away from completion 60% to 70% of the condos have been sold.

This is an interesting development and I’m going to be following it closely and I will be posting another blog soon with pictures and my first impression of the model unit.

I have been working in the Puerto Vallarta real estate market for several years and from my experience the first thing is to ask the developer’s representative to accompany you on a “walkthrough” inspection of your new home in Puerto Vallarta.  During this inspection you want to make a written “punch list” of any damaged or missing items and note any repairs that are necessary.

You may want to start by reviewing all doors and windows. They should be well-fitted, easy to open, close and lock. The floor tile should be evenly laid with no high spots, cracks or scratches.  In the bathrooms make sure there are no chips in the bathtub, toilets, sinks and flooring. See that the cabinets are not loose, lights and fans work, and the caulking is applied correctly. Check for leaks. Open and close all the kitchen cabinets and make sure there are enough electrical outlets and they are working.  Counter tops, sinks, and appliances should not have any damage during the installation. Test all the appliances for proper functioning including the hood fan and light as well as the kitchen lights and switches. Check the paint job throughout and note any scratches, splotches or drops.  Then you want to review the cooling systems (air conditioning and ceiling fans).  Make sure they are all in proper working order and get the remote control units if these are included.  Next, locate your electrical breaker box and confirm there are enough circuits available and they are labeled.  Then check the hot water heater for proper function.  Turn on the hot water and check the temperature and the pressure.  Ask if there are main shut off valves for gas and water and note these locations.

Finally, review the common areas for note items still to be completed. Check the status of the pool is it complete, where is the machinery, is it operational. Elevators and garage doors need the same reviewing. In the garden areas note any lacking green areas or construction materials that are still left on grounds. Have the developer’s representative sign and date the punch list and keep a copy for your records. The items listed “needing attention”, are delivered to the developer and a timeline should be agreed upon so that he can repair such items.

If you miss something on the punch list, or there are unseen problems arise in your unit, here is some good news!  In the Puerto Vallart real estate market, the Jalisco state law provides a six month guarantee of workmanship and function.  This also covers hidden defects.  As we discussed above, it is best if you have the majority of defects listed on a written punch list.  This can save a lot of time and effort on your part.  However, when items do crop up, most developers will professionally attend your requests.  They know that your goodwill and happiness are the keys to success in future projects.

Do you have a question about Real Estate in Puerto Vallarta?  Just ask!

If you are buying in the Puerto Vallarta real estate zone and wish to purchase a preconstruction property,  one of the first things you should request is to see the Deed of Title on the land where the project will be located or “escritura”.  Verify that the Puerto Vallarta land is owned by the developer and if the developer is a corporation, ask to see the articles of Incorporation and Power of attorney.  Is there a master policy of Title Insurance?  The next items to ask for would be approved construction permits, ground use, feasibility studies and density approvals.

Puerto Vallarta Beachfront real estate is highly desirable here for obvious reasons, however it is very important to understand that the beach is public property, owned by the Mexican Nation.  Therefore, it is critical that your development has a Federal Maritime Zone concession and is not encroaching on the federal property.  Also, if your development runs along the highway, that is ALSO federal zone and subject to setback limitations.  So take a good look at your parking plans and understand that you will never have a “deeded” parking place in the federal zone!  Typically, developments have a form purchase agreement.  Ask to see the boilerplate agreement and look for the following items to be included:  plans and specifications of your particular unit and the common areas, construction calendar and penalty clause in case of non-compliance, rules and regulations for the Puerto Vallarta condominium and payment schedule.  If the sales team is promising specific amenities, these should be detailed in the contract.  Then you want to know where your payments are going.  If the developer will be using these funds in order to build the project, what kind of security will he offer in order to insure the project will be completed?  Is there an administrative trust in place? Is it possible to get a completion bond? If the payments are directed to an escrow account, how will they be released?  Verifiable levels of completion would protect you better than calendar dates.   Finally, and perhaps most importantly, what do you know about the developer?  Have they completed other projects in the area or in other Mexico real estate areas?  Do they have experience building on the beach?  If they have had issues in previous buildings, what are they doing to improve yours?  There are many outstanding developments in the bay that have the items listed above on file and will allow you to review them.  Keep in mind that while the developer is building the project, it is YOUR money that is making it all possible!  You can make an offer, even on a new development and negotiate a contract that is fair to both you and the developer.  Purchasing in a new development can be a dream comes true if you use prudence and sound judgment.  Enlist the help of your experienced TOPMexico Realtor to help you review documents, contracts and act as your advocate.

I have always had the image of the water on the Gulf of Mexico being the same as what I see off of the west coast of Florida.  I even heard and read from some people that the beaches in Campeche Mexico were ugly because of the high concentration of the oil industry operations off of Ciudad del Carmen coast line in the southern corner of the state.  But, the Campeche Beachfront real estate that I visited ripped all of my previous assumptions!   These were definitely some of the most desirable Mexico real estate properties that I have visited.

As soon as we drove over the summit of a large hill as we approached Champoton driving in from the north from the capital,  we caught a glimpse of a completely different type of water shades and beaches.  This was turquoise green, transparent water, shades of green tones for approximately 300 meters on white beaches.  Once we passed Champoton (sea food heaven which I will chat about in a later post), we stopped at a l little beach side restaurant and walked on the sand.  SEASHELLS GALORE.  In less than 10 minutes my kids had ran out and gathered about 15 – 20 shells which we never see on the Mexican Caribbean.

The Campeche beaches with white sands run for approximately for a 60 mile stretch south of Champoton till the Isla Aguada.  Most of the Campeche real estate on the beach is rocky except for this 60 mile stretch.

On the backside of these Campeche beachfront lots you will find a lagoon.  The lagoon on the back side connects from Sabancuy water entrance south till the Bay of Terminos.
Nice calm waters and hundreds of miles of waterfront for exploring. Campeche beachfront lots have varying sizes but the majority have 20 meters of beach frontage.  These go back deep with some of the lots having at least 900 meters depth until you reach the back side.  Homes in the area are normally designed to open up onto the beautiful gulf of Mexico and beaches.  There is a 3 story height build restriction and much attention is placed rightfully so in protecting the wild life and natural settings of the zone.

In the past three years, a large project developed by a Spanish group has invested nearly 200 million dollars.  This project is estimated to begin deliveries of their residences in the summer of 2010.  With a Jack Nicklaus golf course and 115 slip marina, it promises to bring much publicity and attention to the region for the following decade.   In the two nearby fishing villages private money is following suit by making some investments to the area preparing for the inflow of new tourists and winter home owners.   Companies such as Chedraui and a private hospital group.  Home depot, Walmart, Mega Comercial Mexicana are all other companies with plans for near future openings in the areas.  Along the coastal highway, we saw men and machinery busy at work with government funded projects placing water pipes and tubing underground.  New bridges and a new by pass are underway to divert the traffic of people driving to Villa Hermosa and other northern destinations away from having to drive through Ciudad del Carmen and along the coastal road.

The Campeche real estate properties along the coast line  that we visited were a surprise of the natural beauty that exists on this hidden little corner of the Gulf of Mexico.  Turquoise green waters and beaches lined with palm trees are what many people dream about for their winter homes.  With large amounts of private and public money being injected to the zone over the past three years, the opportunities on waterfront Mexico real estate is growing on a monthly basis.  If you want to read an article on some information of the CAMPECHE REAL ESTATE market in the capital click here.

The progress has been tremendous inside the stunning Grand Coral gated community and this post will show that pre-construction projects are thriving in the Playa del Carmen real estate market.

Previously reviewed several months ago in another blog, Mareazul these playa del carmen condos, are described as oceanfront and luxurious and are an amazing part of the large puzzle that makes the entire Grand Coral project. Exciting news for the residents and future buyers in the Coco Beach Zone of the north Playa del Carmen real estate market.  There is a new cool and hip beach club / bar that is open to the public. It is called Anibal Royal and has a very cool appearance and ambience. I decided to take a break and venture down yesterday to have a peak, and I ended up really enjoying the atmosphere. I ordered a smoothie and ceviche, which both were excellent, while soaking up the sensational breeze and views of the Caribbean ocean. The staff were super friendly and courteous and the music was grooving from the dj in the booth. 

  Coco beach is mainly a residential area with many of the new Playa del Carmen condos being introduced in this area.  Previously people would have to walk several minutes to Kool or Mamitas beach if they wanted this similar type of ambience. This stylish place will operate as a beach club /restaurant during the day hours and night club in the evening.

   You can either enjoy the atmosphere by the bar,  relax in the wooden lounge chairs closer to the beach or chill in one of the hammocks. The site is full of unique and delightful things, for example, the washrooms are litte huts and the doors open like doors you would find on a submarine!

With pre-construction Cancun condominiums popping up on every corner there is a huge variety of options in the current marketplace. But with so many options to choose from it is sometimes difficult to sift out the one perfect deal that is worth a second look. A question was asked a few days ago regarding a property purchase.

Mexico Real Estate Investment QUESTION

“Can you give us an estimate on the amount that would be due on Mexico Acquisition Taxes for a pre construction condo purchase

I entered into a contract in the summer of 2007 for a unit at Mexico Pre construction Condo “X”. They required a 30% down payment with a final payment of 70% at close.

My contract is all in US dollars How do I calculate the amount that should be captured on the deed and how will this affect the amount payable for the Acquisition Taxes In 2007 the Mexico exchange rate was approximately 10 pesos per dollar and in 2009 we are approximately 15 pesos per dollar

Mexico Real Estate InvestmentANSWER

Even though the purchase price was set in US Dollars, the deed by which the property is transferred will mention Pesos. Since 30% of the purchase price was paid previously at an exchange rate of 10.00 Pesos p/dollar and 70% will be paid at 15.00 p/dollar, the most practical way is to determine the amount paid in Pesos at the time of each payment:

Example:

Purchase Price in Dollars in July 2007 = USD$ 10,000.00

30% Down payment at 10.00 Pesos per dollar paid on July 2007= $30,000.00 Pesos.

70% at closing at 15:00 Pesos per dollar paid on July 2009 = $105,000.00 Pesos

Purchase Price in Pesos to be declared in the deed: $135,000.00 Pesos

It s important that the purchase price calculated is well determined, since it could affect the parties when calculating closing costs. The seller could pay more Mexico Capital Gains Taxes or the purchaser can pay more transfer of property tax and deed registration at the Mexico Public Registry if the figures are not registered correctly.

This week, I was invited to have a tour of a property in Playa del Carmen to see the progress and witness the 'soft opening' of the much anticipated oceanfront hotel condo project, The Fives, located just a couple kms north of downtown Playa del Carmen.
