I\u00c2\u00b4m sure all of you can\u00c2\u00b4t wait for it to begin, so I will dedicate today\u00c2\u00b4s blog to the subject which I will be speaking about. I\u00c2\u00b4ve included special\u00c2\u00a0mention of the role played by your\u00c2\u00a0lawyer and the notary public, who is an important part of the overall process.<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The process of\u00c2\u00a0purchasing a home in Mexico will begin with the preparation of an<\/span><span style=\"font-weight: 400;\"> offer to purchase, <\/span><span style=\"font-weight: 400;\">usually done with a\u00c2\u00a0broker. You will agree\u00c2\u00a0with the developer on an\u00c2\u00a0offer and then send it\u00c2\u00a0to a lawyer in order to\u00c2\u00a0prepare a\u00c2\u00a0promissory contract. This contract will have all the specifications that would finally become\u00c2\u00a0the title. The details of the transaction will include: the price , the timeline, what is included, and the amenities. So it\u00c2\u00b4s really important to have a promissory contract reviewed by a lawyer to insure you are\u00c2\u00a0protected. You will also\u00c2\u00a0need to decide whether\u00c2\u00a0to buy through a bank trust or a corporation if you are purchasing in the restricted zone near the coast or border.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Afterwards your\u00c2\u00a0lawyer needs to prepare whichever of the 2 legal entities that you will be\u00c2\u00a0using to actually acquire the property. On average they take 2 weeks to prepare everything on the bank trust to have everything ready, then the notary needs to send them the draft of the title. After it has been approved\u00c2\u00a0it will be\u00c2\u00a0ready to sign.<\/span><\/p>\n<p><a href=\"https:\/\/www.topmexicorealestate.com\/events\/webinar\/jun-16.php?art=b422&amp;web=p1&amp;A\"><img decoding=\"async\" class=\" aligncenter\" src=\"http:\/\/i255.photobucket.com\/albums\/hh138\/beatlo\/Webinar\/main-page-JUNIO-ian_zps2s1ysgnf.jpg\" alt=\" photo main-page-JUNIO-ian_zps2s1ysgnf.jpg\" border=\"0\" \/><\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">For the corporation you will need to provide 3 options of names for the corporation, and then\u00c2\u00a0apply for one of these names. The government will approve one of them and then everything will be ready to sign for the corporation. In those cases when this document is ready the steps are the same. Once everything is checked they make sure the seller doesn\u00c2\u00b4t have any debts either in water service or some previal tax. Everything that the notaries or the lawyers checked make sure that this property is actually ready to be transfered. The notary prepares the draft of the title and sends it to the lawyer to review that everything is correct and then schedules the date of the final signature.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The notary will then have to collect the necessary\u00c2\u00a0info in order to\u00c2\u00a0finish the closing of the title and the notary needs to certify all the documentation provided by the lawyer and the seller. They prepare everything, pay the taxes, and\u00c2\u00a0send it to the public records. It\u00c2\u00a0will take between 1-4 months for this title to actually be registered. In the meantime you will have a certified copy of the final title.\u00c2\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It\u00c2\u00b4s important for <\/span><span style=\"font-weight: 400;\">someone to review that all the taxes are paid to make sure once you sign\u00c2\u00a0the document and the notary sends it to the public record there isn\u00c2\u00b4t\u00c2\u00a0something affecting the property. If there is\u00c2\u00a0something wrong after\u00c2\u00a0the notary has taken the documents to the public records they will give it\u00c2\u00a0back to the notary for correction.
