{"id":145,"date":"2009-01-31T21:10:31","date_gmt":"2009-01-31T14:10:31","guid":{"rendered":"https:\/\/www.topmexicorealestate.com\/temp-blog\/?p=145"},"modified":"2017-08-29T15:45:00","modified_gmt":"2017-08-29T20:45:00","slug":"security-deposits","status":"publish","type":"post","link":"https:\/\/www.topmexicorealestate.com\/blog\/2009\/01\/security-deposits\/","title":{"rendered":"Mexico Real Estate Rental Security Deposits:  How to Manage"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"black;\"><span style=\"small;\"><span style=\"Calibri;\">If you own a <a title=\"Mexico Real Estate Rental Properties\" href=\"https:\/\/www.topmexicorealestate.com\" target=\"_blank\">Mexico Real Estate Rental<\/a>, you will need to learn how to administer the security deposits.The security deposit is any advance of money, other than a rental application deposit or an advance payment of rent that is intended primarily to secure performance under a lease of a dwelling that has been entered into by a landlord and a tenant. <a title=\"Texas Property Code\" href=\"http:\/\/tlo2.tlc.state.tx.us\/statutes\/docs\/PR\/content\/htm\/pr.008.00.000092.00.htm\" target=\"_blank\">(Texas property code Sec92.102).<\/a><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"black;\"><span style=\"small;\"><span style=\"Calibri;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"float: right; margin: 5px;\" src=\"http:\/\/i255.photobucket.com\/albums\/hh138\/beatlo\/Banks\/vault_bankimage2-1.jpg\" alt=\"Rawson Vault .com\" width=\"264\" height=\"264\" \/>In Mexico, there are no limits on how much you can charge for a security deposit. For long-term rentals, many Mexican Landlords charge an amount equal to one month s rent and this amount is standard practice. <\/span><\/span><\/span><\/p>\n<h3 class=\"MsoNormal\" style=\"0in 0in 10pt;\"><span style=\"black;\"><span style=\"small;\"><span style=\"Calibri;\">MEXICO SECURITY DEPOSIT<\/span><\/span><\/span><\/h3>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"black;\"><span style=\"small;\"><span style=\"Calibri;\">The security deposit is held by the Landlord, sometimes in an interest-bearing account, until the Tenant fulfills the obligations of the lease agreement. Some areas of Mexico require that you pay the Tenant the interest earned on the deposit and some areas do not. However, the security deposit does not belong to the Landlord it belongs to the Tenant. I always recommend that the <a title=\"Mexico Property Owner How To\" href=\"https:\/\/www.topmexicorealestate.com\/blog\/2008\/11\/17\/the-how-tos-of-long-term-rental-properties\/\" target=\"_blank\">property manager in Mexico <\/a>hold onto the security deposit in a trust account so that there is no confusion on disbursement of this deposit when the Tenant vacates. <\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"black;\"><span style=\"small;\"><span style=\"Calibri;\">When the Tenant vacates, do an inspection of the property. Some landlords prefer to do this inspection with the Tenant and some prefer to do it without the Tenant present. The choice is yours. To avoid potential disputes, make sure that if you are going to deduct any charges for property damages from the Tenant s security deposit, you take pictures of that damage for future record. Do not deduct for normal wear and tear or if the damage were there prior to move in. You can deduct for unpaid rent, late charges, etc. <\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"black;\"><span style=\"small;\"><span style=\"Calibri;\">Send a full itemized report to the Tenant outlining charges and deductions within 30-days of move out. <\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"Calibri;\">If you hire a property manager in Mexico, they will handle all aspects of the security deposit for you.
