On Thursday, Bea posted about AMPI\u00e2\u20ac\u2122s new board of directors (for the Playa del Carmen Chapter) and briefly mentioned a new proposed law which AMPI is promoting in the area.\u00c2\u00a0 Today I want to share a few more details about this law and talk about what it could mean for Playa del Carmen real estate<\/a>.<\/p>\n

As things stand currently, anyone can open up an office and stick a sign out front saying they are a real estate agent.\u00c2\u00a0 There are no requirements for real estate agents to have certificates, experience or licenses.\u00c2\u00a0 It is in the hands of the buyer to research the office they are working with, ask for qualifications and check references.<\/p>\n

Basically the new proposed law would create a requirement that real estate offices be licensed to operate as such.<\/p>\n

\"PlayaSo far, most of Mexico does not have any federal license requirements for real estate agents. This law is being considered in the state of Quintana Roo, which also includes the Cancun real estate<\/a>, Cozumel real estate<\/a>, Tulum real estate<\/a> and Costa Maya real estate<\/a> markets.\u00c2\u00a0 There are 9 other states which have recently implemented similar laws.<\/p>\n

This law is good news all around for Playa del Carmen and the rest of the state!\u00c2\u00a0 The requirement for a license means that practicing real estate brokers and agents will hold qualifications and a good professional record.<\/p>\n

Buyers would still have to do their homework; they would need to check references and investigate some of the more intangible aspects, such as dedication to buyers\u00e2\u20ac\u2122 needs, good communication and attention to those little details that make a big difference in how smooth the process goes; these items can\u00e2\u20ac\u2122t be reflected in a license.<\/p>\n

However, the license would remove some large and significant variables.\u00c2\u00a0 \u00e2\u20ac\u0153Does the office I\u00e2\u20ac\u2122m considering have sufficient experience, knowledge and qualifications?\u00e2\u20ac\u009d The license will remove these doubts and allow buyers to focus on the finer details of service when choosing their office, as mentioned above.<\/p>\n

In short, the law would give professionalism in the area\u00e2\u20ac\u2122s real estate industry a significant boost, pushing standards up to a new level.<\/p>\n

El Jueves Bea escribi\u00c3\u00b3 sobre la toma de protesta de los nuevos asociados del AMPI (la Asociaci\u00c3\u00b3n Mexicana de Profesionales Inmobiliarios) en las diferentes secciones de la Riviera Maya, y sobre la iniciativa de ley para la regulaci\u00c3\u00b3n del sector inmobiliario en el estado de Quintana Roo. Hoy quisiera profundizar un poco m\u00c3\u00a1s sobre este tema, algo que podr\u00c3\u00ada catapultar los bienes ra\u00c3\u00adces en Playa del Carmen<\/a>\u00c2\u00a0y en la Riviera Maya.<\/p>\n

El panorama hoy en d\u00c3\u00ada en el sector inmobiliario es ambiguo. Cualquiera puede abrir una oficina, poner un escritorio o colgar letreros afuera de una propiedad y autonombrarse agente inmobiliario. No existen requerimientos legales, ni credenciales oficiales que certifiquen el trabajo del asesor en bienes ra\u00c3\u00adces, no existen licencias. Es por el contrario, trabajo del comprador, investigar si la agencia o el agente cuenta con las referencias necesarias para realizar el trabajo.<\/p>\n

\"Playa<\/p>\n

Sin embargo la iniciativa de ley que se encuentra en el Congreso del Estado apuntala a regularizar y profesionalizar el sector inmobiliario, obligando a las personas que decidan prestar estos servicios a contar con la licencia oficial que certifique su trabajo.<\/p>\n

Hasta hoy en d\u00c3\u00ada es facultad de los estados regular o no el trabajo del agente inmobiliario. Con esto Quintana Roo se suma a los otros 9 estados que ya han derogado leyes en este sentido incluido el Distrito Federal, lo que ayudar\u00c3\u00a1 a \u00c2\u00a0profesionalizar el mercado de los bienes ra\u00c3\u00adces en Canc\u00c3\u00ban<\/a>, los bienes ra\u00c3\u00adces en Cozumel<\/a>, los bienes ra\u00c3\u00adces en Tulum<\/a>, as\u00c3\u00ad como los bienes ra\u00c3\u00adces en Costa Maya<\/a>.<\/p>\n

El mayor beneficio de esta ley es que ayudar\u00c3\u00a1 a dar certeza legal a los compradores, garantizando la validez jur\u00c3\u00addica de su inversi\u00c3\u00b3n. Considerando que 2 de cada 10 transacciones inmobiliarias en el Estado de Quintana Roo terminan en litigio, el beneficio que se espera encontrar con esta nueva ley es fundamental.<\/p>\n

Claro que los compradores seguir\u00c3\u00a1n teniendo la obligaci\u00c3\u00b3n de buscar contratar los servicios del agente o agencia que le ofrezca la mejor calidad de trabajo, profesionalismo y dem\u00c3\u00a1s, sin embargo con la nueva ley se eliminar\u00c3\u00a1n todas aquellas personas que actualmente prestan los servicios sin contar con los estudios, el historial profesional o la capacidad laboral para llevar acabo el trabajo. Lo que ayudar\u00c3\u00a1 a simplificar el trabajo del comprador.<\/p>\n

En palabras cortas, la ley ayudar\u00c3\u00a1 a profesionalizar la industria inmobiliaria y el trabajo del agente, algo hasta este momento in\u00c3\u00a9dito en el pa\u00c3\u00ads.
