{"id":6330,"date":"2013-04-23T17:15:18","date_gmt":"2013-04-23T23:15:18","guid":{"rendered":"https:\/\/www.topmexicorealestate.com\/temp-blog\/?p=6330"},"modified":"2017-08-28T16:21:07","modified_gmt":"2017-08-28T21:21:07","slug":"breaking-news-bill-to-eliminate-mexicos-bank-trust-passes-first-step","status":"publish","type":"post","link":"https:\/\/www.topmexicorealestate.com\/blog\/2013\/04\/breaking-news-bill-to-eliminate-mexicos-bank-trust-passes-first-step\/","title":{"rendered":"<!--:en-->BREAKING NEWS &#8211; Bill to Eliminate Mexico&#8217;s Bank Trust Passes First Step!<!--:--><!--:es-->Reforma a la ley permitir\u00c3\u00a1 que extranjeros puedan comprar propiedades en la playa.<!--:-->"},"content":{"rendered":"<p><!--:en--><img loading=\"lazy\" decoding=\"async\" class=\" alignleft\" title=\"Is ownership by Bank Trust be a thing of the past?\" src=\"http:\/\/i255.photobucket.com\/albums\/hh138\/beatlo\/Playa%20del%20Carmen%20photos\/Playa%20del%20Carmen%20Beaches\/IMG_5956_zps26ee8901.jpg\" alt=\"Mexico real estate\" width=\"240\" height=\"179\" \/><\/p>\n<p>We&#8217;ve received some very exciting and important news:<\/p>\n<p><em>It looks very likely that Americans, Canadians and other non-Mexicans will no longer be required to own property in Mexico by means of a Bank Trust!<\/em><\/p>\n<p><strong>The Bill Passes the Chamber of Deputies<\/strong><\/p>\n<p>This afternoon, Mexico&#8217;s lower legislative house (&#8220;Chamber of Deputies&#8221; which is basically the same as the our House of Representatives) passed a bill which would modify the Mexican Constitution.<\/p>\n<p>Currently, article 27 of the Constitution restricts ownership within 30 miles of the coast and 60 miles of any international border; in this &#8220;Restricted Zone&#8221; non-Mexicans cannot own property directly but must own by means of a Bank Trust (&#8220;fideicomiso&#8221; in Spanish.)<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" alignright\" title=\"The new bill aims to eliminate the need for ownership by Bank Trust\" src=\"http:\/\/i255.photobucket.com\/albums\/hh138\/beatlo\/realtor%20real%20estate\/Fideicomiso_zps0b8596b5.png\" alt=\"Mexico real estate\" width=\"240\" height=\"240\" align=\"alignright\" \/><\/p>\n<p><strong>The Changes -No Bank Trust for Residential Property<\/strong><\/p>\n<p>The new bill which passed the Chamber of Deputies today would modify this article to allow for direct ownership of property by non-Mexicans for\u00c2\u00a0<em><strong>residential purposes.<\/strong><\/em><\/p>\n<p>It is worth noting that direct ownership will still not be permitted for any profitable purpose (commercial, agriculture, etc.)<\/p>\n<p><strong>The Reasons &#8211; Outdated Concerns of Invasion<\/strong><\/p>\n<p><strong><\/strong>Basically, as far as I understand, when the Constitution was drafted (1917) there was a fear that allowing foreigners to own property on the coast or near the border would allow them to accumulate large amounts of property and either stage an invasion from their home country or declare independence to take the land for their home country. \u00c2\u00a0After a century of revolutions and upheavals, the country was also very unstable making such concerns more real.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" alignleft\" title=\"Raul Paz Alonzo, one of the representatives who created the bill.\" src=\"http:\/\/yucatan.com.mx\/wp-content\/uploads\/2012\/12\/RAUL-PAZ-3.jpg\" alt=\"Mexico real estate\" width=\"240\" height=\"362\" align=\"alignleft\" \/><\/p>\n<p>These days, I can&#8217;t imagine the retirees and sunbathers in Cancun doing either! El d\u00c3\u00ada de hoy la c\u00c3\u00a1mara de diputados aprob\u00c3\u00b3 por mayor\u00c3\u00ada absoluta la reforma al art\u00c3\u00adculo 27 de la constituci\u00c3\u00b3n sobre el derecho de propiedad de tierras en la naci\u00c3\u00b3n, para permitir la compra de bienes inmuebles a extranjeros en las zonas costeras del pa\u00c3\u00ads. La antigua ley restring\u00c3\u00ada el derecho de propiedad a extranjeros en inmuebles ubicados a 50 kil\u00c3\u00b3metros de distancia de las costas del pa\u00c3\u00ads, esto como medida precautoria en la constituci\u00c3\u00b3n firmada en 1917 ante la eventualidad de una invasi\u00c3\u00b3n extranjera.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright\" title=\"The new bill aims to eliminate the need for ownership by Bank Trust\" src=\"http:\/\/i255.photobucket.com\/albums\/hh138\/beatlo\/realtor%20real%20estate\/Fideicomiso_zps0b8596b5.png\" alt=\"Mexico real estate\" width=\"240\" height=\"240\" align=\"alignright\" \/>Sin embargo, aunque por ley est\u00c3\u00a1 prohibido que un extranjero posea propiedades en los l\u00c3\u00admites costeros del pa\u00c3\u00ads, en la pr\u00c3\u00a1ctica esto es algo que no se cumple del todo. Mediante recursos legales la compra de bienes inmuebles por extranjeros ha sido posible, esto a trav\u00c3\u00a9s de algo llamado &#8220;fideicomiso&#8221;, que no es m\u00c3\u00a1s que un documento legal que avala la propiedad del bien inmueble a trav\u00c3\u00a9s de una instituci\u00c3\u00b3n financiera. Lo que sucede es que el banco funge como intermediario al retener el t\u00c3\u00adtulo de propiedad del inmueble, pero el extranjero mantiene los derechos sobre ese fideicomiso.<\/p>\n<p>Claro, el problema con esto son los costos. El tema claramente es un problema econ\u00c3\u00b3mico. Para un extranjero resulta mucho m\u00c3\u00a1s caro, tardado y laborioso comprar una propiedad en la playa. Con esta reforma a la ley se regularizar\u00c3\u00a1 algo que por a\u00c3\u00b1os ya se hac\u00c3\u00ada. Lo que alentar\u00c3\u00a1 la inversi\u00c3\u00b3n inmobiliaria en todas las zonas tur\u00c3\u00adsticas del pa\u00c3\u00ads. La iniciativa de esta reforma a la ley pretende inyectar dinamismo al mercado inmobiliario tur\u00c3\u00adstico. Abaratando los costos, agilizando los tr\u00c3\u00a1mites y dotando de mayor seguridad legal a los miles de extranjeros que ven en las playas del pa\u00c3\u00ads el lugar ideal para comprar propiedades vacacionales.<\/p>\n<p><strong>Siguiente paso, el Senado.<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" title=\"Raul Paz Alonzo, one of the representatives who created the bill.\" src=\"http:\/\/yucatan.com.mx\/wp-content\/uploads\/2012\/12\/RAUL-PAZ-3.jpg\" alt=\"Mexico real estate\" width=\"240\" height=\"362\" align=\"alignleft\" \/><\/p>\n<p>La ley ahora pasar\u00c3\u00a1 al Senado de la Rep\u00c3\u00bablica para su revisi\u00c3\u00b3n y aprobaci\u00c3\u00b3n, y posterior a esto tendr\u00c3\u00a1 que ser aprobada por la mitad de los congresos locales del pa\u00c3\u00ads.
