{"id":252,"date":"2013-04-24T17:32:50","date_gmt":"2013-04-24T22:32:50","guid":{"rendered":"http:\/\/www.topmexicorealestate.com\/brokers\/?p=252"},"modified":"2014-08-22T11:13:24","modified_gmt":"2014-08-22T16:13:24","slug":"no-more-bank-trust-for-mexico-real-estate","status":"publish","type":"post","link":"https:\/\/www.topmexicorealestate.com\/brokers\/2013\/04\/no-more-bank-trust-for-mexico-real-estate\/","title":{"rendered":"<!--:en-->No More Bank Trust for Mexico Real Estate?<!--:--><!--:es-->Reforma al art\u00edculo 27 constitucional.<!--:-->"},"content":{"rendered":"<p><!--:en--><div id=\"attachment_253\" style=\"width: 310px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-253\" class=\"size-medium wp-image-253\" alt=\"Bank Trust Fideicomiso in Mexico real estate\" src=\"http:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-Chamber-of-Deputies-300x199.jpg\" width=\"300\" height=\"199\" srcset=\"https:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-Chamber-of-Deputies-300x199.jpg 300w, https:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-Chamber-of-Deputies-1024x682.jpg 1024w, https:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-Chamber-of-Deputies.jpg 2000w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-253\" class=\"wp-caption-text\">The Mexico Chamber of Deputies passed the law yesterday<\/p><\/div><\/p>\n<p>As I already pointed out in our other blog, yesterday Mexico&#8217;s Chamber of Deputies passed a law which would eliminate the requirement for owning by means of a Bank Trust for non-Mexicans.<\/p>\n<p>Some background about the Bank Trust as it currently stands:<\/p>\n<ul>\n<li>non-Mexicans are not permitted to own directly in the &#8220;Restricted Zone&#8221;<\/li>\n<li>this &#8220;Restricted Zone&#8221; is 60 m along any border or 30 miles along any coast<\/li>\n<li>this restriction is a part of Mexico&#8217;s Constitution (article 27)<\/li>\n<li>the Bank Trust allows for ownership in this area<\/li>\n<li>the bank holds the title<\/li>\n<li>the owners is the second beneficiary<\/li>\n<li>it offers all rights and privileges of direct ownership<\/li>\n<\/ul>\n<p>The new law would modify the constitution to allow for direct ownership in the &#8220;Restricted Zone.&#8221; \u00a0Some details include:<\/p>\n<ul>\n<li>The modification would apply to <em><strong>residential property only.<\/strong><\/em><\/li>\n<li>Direct ownership would still NOT be permitted for property for commerce, industry or agriculture.<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-254 alignright\" style=\"text-align: right;\" alt=\"Mexico title deed\" src=\"http:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-title-deed-300x194.jpg\" width=\"300\" height=\"194\" srcset=\"https:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-title-deed-300x194.jpg 300w, https:\/\/www.topmexicorealestate.com\/brokers\/wp-content\/uploads\/2013\/04\/Mexico-title-deed.jpg 358w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>The law has currently passed the Chamber of Deputies, which is the equivalent of the House of Representatives in the U.S. To be applied as law, it also has to gain the approval of the Senate.<\/p>\n<p>Currently, I am not aware if there is any timeline or expected time frame within which there will be a vote from the Senate. \u00a0Someone has also mentioned to me that approval from half of the state governors is required. \u00a0I have not seen this in Mexican news sources yet, but I will keep an eye open for new information and offer updates as they are available.<\/p>\n<p>&#8212;<\/p>\n<p><strong>Thomas Lloyd<\/strong><em> graduated from Purdue University Krannert School of Management with a degree in Management\/Financial Option Investments.
