New Law Proposes Higher Standards for Professionalism in Playa del Carmen Real EstateNueva Ley de Regulación de Agentes Inmobiliarios en el estado de Quintana Roo.

On Thursday, Bea posted about AMPI’s new board of directors (for the Playa del Carmen Chapter) and briefly mentioned a new proposed law which AMPI is promoting in the area.  Today I want to share a few more details about this law and talk about what it could mean for Playa del Carmen real estate.

As things stand currently, anyone can open up an office and stick a sign out front saying they are a real estate agent.  There are no requirements for real estate agents to have certificates, experience or licenses.  It is in the hands of the buyer to research the office they are working with, ask for qualifications and check references.

Basically the new proposed law would create a requirement that real estate offices be licensed to operate as such.

So far, most of Mexico does not have any federal license requirements for real estate agents. This law is being considered in the state of Quintana Roo, which also includes the Cancun real estate, Cozumel real estate, Tulum real estate and Costa Maya real estate markets.  There are 9 other states which have recently implemented similar laws.

This law is good news all around for Playa del Carmen and the rest of the state!  The requirement for a license means that practicing real estate brokers and agents will hold qualifications and a good professional record.

Buyers would still have to do their homework; they would need to check references and investigate some of the more intangible aspects, such as dedication to buyers’ needs, good communication and attention to those little details that make a big difference in how smooth the process goes; these items can’t be reflected in a license.

However, the license would remove some large and significant variables.  “Does the office I’m considering have sufficient experience, knowledge and qualifications?” The license will remove these doubts and allow buyers to focus on the finer details of service when choosing their office, as mentioned above.

In short, the law would give professionalism in the area’s real estate industry a significant boost, pushing standards up to a new level.

El Jueves Bea escribió sobre la toma de protesta de los nuevos asociados del AMPI (la Asociación Mexicana de Profesionales Inmobiliarios) en las diferentes secciones de la Riviera Maya, y sobre la iniciativa de ley para la regulación del sector inmobiliario en el estado de Quintana Roo. Hoy quisiera profundizar un poco más sobre este tema, algo que podría catapultar los bienes raíces en Playa del Carmen y en la Riviera Maya.

El panorama hoy en día en el sector inmobiliario es ambiguo. Cualquiera puede abrir una oficina, poner un escritorio o colgar letreros afuera de una propiedad y autonombrarse agente inmobiliario. No existen requerimientos legales, ni credenciales oficiales que certifiquen el trabajo del asesor en bienes raíces, no existen licencias. Es por el contrario, trabajo del comprador, investigar si la agencia o el agente cuenta con las referencias necesarias para realizar el trabajo.

Sin embargo la iniciativa de ley que se encuentra en el Congreso del Estado apuntala a regularizar y profesionalizar el sector inmobiliario, obligando a las personas que decidan prestar estos servicios a contar con la licencia oficial que certifique su trabajo.

Hasta hoy en día es facultad de los estados regular o no el trabajo del agente inmobiliario. Con esto Quintana Roo se suma a los otros 9 estados que ya han derogado leyes en este sentido incluido el Distrito Federal, lo que ayudará a  profesionalizar el mercado de los bienes raíces en Cancún, los bienes raíces en Cozumel, los bienes raíces en Tulum, así como los bienes raíces en Costa Maya.

El mayor beneficio de esta ley es que ayudará a dar certeza legal a los compradores, garantizando la validez jurídica de su inversión. Considerando que 2 de cada 10 transacciones inmobiliarias en el Estado de Quintana Roo terminan en litigio, el beneficio que se espera encontrar con esta nueva ley es fundamental.

Claro que los compradores seguirán teniendo la obligación de buscar contratar los servicios del agente o agencia que le ofrezca la mejor calidad de trabajo, profesionalismo y demás, sin embargo con la nueva ley se eliminarán todas aquellas personas que actualmente prestan los servicios sin contar con los estudios, el historial profesional o la capacidad laboral para llevar acabo el trabajo. Lo que ayudará a simplificar el trabajo del comprador.

En palabras cortas, la ley ayudará a profesionalizar la industria inmobiliaria y el trabajo del agente, algo hasta este momento inédito en el país. Esto es precisamente algo que Top México Real Estate ha estado promoviendo durante mucho tiempo.
